Refund & Cancellation Policy

KabayanTranslate (the "Service") is operated by Lexcode Inc. ("Lexcode", "we", "us", or "our"). This Refund & Cancellation Policy explains when and how you may cancel a translation order and when you are entitled to a refund.
This policy is provided in accordance with the Act on the Consumer Protection in Electronic Commerce (전자상거래 등에서의 소비자보호에 관한 법률), the Framework Act on Consumers (소비자기본법), and related Korean laws. Where any term of this policy is less favorable to you than a mandatory provision of Korean law, the mandatory provision prevails.
1. Our services are prepared to order
Every translation is produced specifically for you based on the source documents you submit. Because our work is custom-made and, in most cases, begins soon after your order is confirmed, your statutory right to withdraw an order (청약철회) is limited once work has begun, to the extent permitted under Article 17(2) of the Act on the Consumer Protection in Electronic Commerce. The rules below explain what refund you are entitled to at each stage.
2. Cancellation before we begin work
If you cancel before a translator has started work on your order, you are entitled to a full 100% refund of the amount you paid.
3. Cancellation after work has begun (before delivery)
If you cancel after work has started but before we deliver the completed translation, we will refund the amount you paid less the value of the work already completed, calculated on a pro-rata basis. We will tell you the completed portion and the corresponding amount before processing the refund.
4. After delivery
Once a translation has been completed and delivered to you, it is generally non-refundable, except where the deliverable is defective or does not conform to your order because of our error (see Section 6), or where a refund is required by mandatory Korean law. Free revisions are available for errors attributable to us as described in Section 7.
5. Errors caused by the source file you provided (not refundable)
We translate the source file you submit, exactly as you submit it. You are responsible for the accuracy, completeness, and suitability of the documents you upload. No refund is due, and any re-work is chargeable, where an issue arises from a cause on your side, including but not limited to:
- uploading the wrong file, wrong version, or an incomplete file;
- illegible, corrupted, or poor-quality source documents;
- errors, omissions, or ambiguities already present in your source text;
- names, dates, figures, or spellings that you instructed us to follow;
- a translation that is later rejected because the source document itself did not meet the receiving party's requirements.
In these cases you remain responsible for the order. We are happy to prepare a new quote for a corrected order.
6. If a translation is rejected because of our error (100% refund, less card fees)
If you ordered a translation from us and it is rejected, denied, or refused by the receiving authority (for example, an immigration office, court, university, embassy, or government agency) because of our error, or because our translation failed to meet a certification, credential, or formatting requirement that we were responsible for meeting, then, at your choice, we will either:
- correct the translation free of charge, as a priority; or
- refund 100% of the price you paid for that order, less the non-refundable payment-processing (credit card) fees charged by the payment provider on the original transaction.
This guarantee does not apply where the rejection results from a source-file issue described in Section 5, from a requirement that we clearly stated in advance we do not cover, or from a change in the receiving authority's requirements that took effect after we delivered your translation. The deduction of payment-processing fees applies to this service-quality remedy only; it does not apply to a refund made under a mandatory statutory withdrawal (청약철회) or where Korean law otherwise requires a full refund, in which case we refund in full as required by law.
7. Free revisions
If a completed translation contains an error that is attributable to us (for example, a mistranslation, typographical error, or omission on our part), notify us within 7 days of delivery and we will revise it free of charge. Requests for changes that are not the result of our error, such as new preferences, changed source text, or additional content, are treated as a new order and quoted accordingly.
8. Non-refundable amounts
The following amounts are not refundable once incurred, even where a partial refund otherwise applies:
- third-party fees paid on your behalf, for example notarization, apostille, courier, or government filing fees; and
- payment-processing (credit card) fees, as described in Section 6, for refunds made under our service-quality remedy.
9. How refunds are issued
- Refunds are made to the original payment method used for the order.
- We process eligible refunds within 3 business days of the refund obligation arising, in accordance with Article 18 of the Act on the Consumer Protection in Electronic Commerce. Where payment was made by credit card, the card company will credit your account according to its own billing cycle.
- If a refund to the original method is not possible, we will agree an alternative method with you.
10. How to request a refund or cancellation
Email support@kabayantranslate.com with your order number and a short description of your request. We will respond within a reasonable time and, where a refund is due, process it as set out above.
11. Dispute resolution
If we cannot resolve a refund dispute directly, you may seek assistance from the Korea Consumer Agency (한국소비자원, 1372) or apply to the Electronic Commerce Dispute Mediation Committee (전자거래분쟁조정위원회). Nothing in this policy limits any right or remedy available to you as a consumer under Korean law.
